Regarding this issue, LawNet would like to answer as follows:

In order to implement Decree 03/2024/ND-CP according to regulations, Vietnam Social Security's guidelines for the implementation of specialized inspections (Social Insurance) is focusing on directing the preparation of related contents, including the development of documents to replace Decision 1518/QD-BHXH dated October 18, 2016 promulgating regulations on the activities of personal labor payment for social insurance, unemployment insurance, health insurance and inspection activities of the Vietnam Social Security's guidelines for the implementation of specialized inspections Industry. In order to ensure that the work of unemployment insurance at the social insurance of provinces and centrally run cities (provincial social insurance) is not interrupted, while waiting for the promulgation of regulations appropriate to the new situation, Vietnam Social Security's guidelines for the implementation of specialized inspections guides the Provincial Social Insurance to implement the following contents:

(1) Thoroughly disseminate the contents and regulations of Decree 03/2024/ND-CP to each inspection officer and relevant agencies, organizations, and individuals.

(2) Regarding implementation of handicraft duties

- Assignment of people to carry out technical information processing tasks

The Director of Provincial Social Insurance shall, based on the provisions in Clause 2, Article 24 of Decree 03/2024/ND-CP, issue a decision to assign the task of personal information processing from March 1, 2024, to subjects who are Deputy Directors of Provincial Social Insurance; Head of Department, Deputy Head of Department of Inspection; Head of Department, Deputy Head of Department of Revenue Management, Books - Cards; Directors, Deputy Directors of Social Insurance of districts, towns, and provincial cities; and officials of the Inspection Department when fully meeting the following conditions and standards:

+ Have been appointed to the rank of specialist or equivalent, have expertise and skills appropriate to the major, and understand the law, including at least 01 year of professional experience in the field of revenue management, card books, inspection, and examination (excluding probationary period).

+ Have a certificate of professional inspection training or an inspector certificate from a competent state agency.

- The assignment of the Head of the inspection team

The Director of the Provincial Social Insurance Agency shall, based on the provisions in Clause 2 of Article 33 of Decree 03/2024/ND-CP and the ability of the person assigned to perform the task of personal information processing, assign the position of Head of the inspection team. The Director of Provincial Social Insurance is responsible before the General Director for assigning the head of the inspection team.

- Uniforms and inspection cards specialized in social insurance

Uniforms and personal information cards (still valid) have been issued to people performing personal information tasks until there are new regulations from the General Director of Vietnam Social Security's guidelines for the implementation of specialized inspections.

- Regarding authority, order, procedures, and deadlines in handicraft activities; duties and powers of the head of the agency assigned to perform the function of information technology; the person assigned to perform the task of information technology; the head of the delegation, members of the information technology delegation

The Provincial Social Insurance Agency shall use the provisions of the Law on Inspection, Decree 43/2023/ND-CP dated June 30, 2023, of the Government detailing a number of articles and measures to implement the Law on Inspection, and Decree 03/2024/ND-CP to organize implementation as basis.

Particularly, the information and reporting regime in inspection activities continues to comply with the provisions of Decision 1518/QD-BHXH and amended documents.

(3) About performing inspection

Competence, order, procedures, deadlines in inspection activities, information regime, reporting and tasks and powers of the inspection team leader and members continue to perform according to the provisions of Decision 1518/QD-BHXH and amended and supplemented documents.

(4) Regarding direction of inspection and examination work

In order for the personal information technology and inspection activities to be carried out consistently, promptly and effectively, the General Director requested the Director of the Provincial Social Insurance to be directly in charge and direct the inspection and examination work.
