On August 30, 2024, Vietnam Social Security issued Official Dispatch 2977/BHXH-TCCB regarding the guidance on organizing, personnel, transferring tasks, finances, and assets for merging units according to the Resolution of the Standing Committee of the National Assembly.

Based on the Decision defining the functions, tasks, powers, and organizational structure of social security at the provincial and district levels, the provincial social security office shall rearrange, transfer functions and tasks, and assign personnel at rearranged units (including both managerial public employees and non-managerial public employees). The leadership team and party committee of the provincial social security office shall review, discuss the personnel arrangement plan, and unify the approach by resolution, after which the provincial social security office shall implement:

(1) The leadership team and party committee of the provincial social security office shall evaluate managerial public employees at units; based on the qualifications, capabilities, and reputation of each specific personnel, they shall consider, discuss, and agree on an overall arrangement plan via resolution.

(2) For social security offices of merging districts:

- Appointment, transfer, and appointment of managerial public employees

+ For managerial public employees who are Directors of district-level social security offices, they shall be considered for appointment to an equivalent position or be transferred to a lower position at merging or rearranged district social security offices, or be considered for transfer and appointment to a managerial position in the professional departments of the provincial social security office according to the district merger resolution towards the city where the provincial social security office is headquartered: The leadership team and party committee of the provincial social security office shall base the consideration on the qualities, capabilities, and reputations of managerial public employees, agree on a resolution, and submit it for the General Director's approval (via the Personnel Department) without having to go through the prescribed personnel procedures; the reappointment term of managerial public employees is calculated from the effective date of the appointment decision according to the old position.

+ For managerial public employees who are Deputy Directors of district-level social security offices: The leadership team and party committee of the provincial social security office shall base the consideration on the qualities, capabilities, and reputations of managerial public employees, agree on a resolution, and decide according to the delegation of powers without going through the prescribed personnel procedures.

+ For managerial public employees considered for appointment to higher positions or transferred to other units outside the merging or rearranged district social security offices, the provincial social security office shall follow the procedures prescribed by Vietnam Social Security.

+ In cases where managerial public employees are considered for appointment but have less than 2 years remaining until retirement, the appointment shall follow the provisions at Point a of this Section.

- Based on the number of deputy managerial public employees at merging or rearranged district social security offices, the provincial social security office shall rearrange and assign them to subordinate units suitable for the capabilities, strengths of each managerial public employee, ensuring: No later than 5 years from the effective date of the National Assembly Standing Committee's resolution on arranging each administrative unit, the number of leaders, managers, and the number of officials and public employees, and workers in rearranged units must comply with the regulations and guidelines of Vietnam Social Security. In special cases, submit to the General Director for consideration and decision.

- For non-managerial public employees, the leadership team and party committee of the provincial social security office shall evaluate the capabilities and strengths of each public employee, emphasizing the importance of augmenting the human resources for district-level social security offices, reducing intermediaries, and reducing indirect personnel at the provincial social security office. Based on this, they shall issue a resolution regarding the overall arrangement for district-level social security offices ensuring streamlined, effective, and efficient operations, meeting the task requirements at district-level social security offices, suitable for the qualifications and professional skills of public employees, and the job position requirements.

- Public employees at merging or rearranged district social security offices shall retain their approved equivalent planning positions.

(3) For managerial public employees being reassigned, if the new position has a lower position allowance coefficient than the current position, the current allowance shall be maintained until the end of the appointment term. If the term is less than 6 months, the allowance shall be maintained for 6 months.

Managerial public employees during the allowance retention period: when considering appointment to a higher position, it is not necessary to supplement the planning for the current position, which is receiving the allowance retention.

(4) Ensure democracy, objectivity, and transparency in the process of organizing and staffing; review, evaluate, and arrange the public employees at district-level social security offices; promptly resolve policies for public employees subject to mergers and rearrangements; if the public employee fails to meet task requirements or has personal requests, consider implementing staff streamlining policies as per regulations.
