Vietnam: Shall the denunciation be handled in case denouncers did not write name and address?

This is an important content mentioned at the Circular No. 129/2020/TT-BCA issued on December 08, 2020 on denunciation settlement process in the people's public security of Vietnam.

According to Clause 1 Article 25 of the Law on Denunciation 2018 of Vietnam, upon receipt of a denunciation, if it is impossible to identify full name and address of the denouncer or identify the denouncer despite verification, or the denouncer uses another person’s full name to make the denunciation or the denunciation is not made using the methods prescribed in Article 22 of this Law, the competent organization/individual must not settle the denunciation as prescribed by this Law.

However, if the denunciation information has clear content about the person committing the law violation, there are documents and specific evidences about the law violation and there are grounds for verification, the head of the agency and competent police unit settle shall organize the examination of information about the denounced person, the denounced law violation act, and the cases with signs of law violation mentioned in the denunciation and other relevant information, if there are specific documents on law violations and violators and there are grounds for verification, an irregular inspection or inspection shall be conducted to serve the management (according to Article 7 of the Circular No. 129/2020/TT-BCA).

Thus, for denunciation information without full name and address of the denouncer, the authenticity of documents and evidence provided by the denouncer shall be determined. If there is a basis for trust and verification, the inspection will be conducted unexpectedly, if the denunciation information cannot be verified, it will not be handled.
