Vietnam: Selection of personnel to work at public service providers must ensure transparency and openness

In Article 3 of Decree 106/2020/ND-CP, the principles of determining job positions and the number of employees in public service providers in Vietnam are stipulated as follows:

- Strictly implement the policies of the Communist Party of Vietnam and the law regarding job positions, number of employees and downsizing in public service providers.

- Align with the functions, tasks, powers, and organizational structure of the public service provider.

- Ensure scientific, objective, public, transparent, and effective processes, and enhance the quality of public employees and employees in public service providers.

- Ensure that one employee is assigned enough workload to perform within the regulated working hours. Positions without sufficient workload to meet the regulated hours for one employee must be assigned additional tasks.

- Ensure a reasonable structure where the number of staff in sector-specific professional titles and general professional titles accounts for at least 65% of the total staff in the public service provider.

To be specific:

+ The determination of job positions in public service providers is based on:

++ The functions, tasks, powers, and organizational structure of the public service provider;

++ The complexity, nature, characteristics, scale of activities; the scope and target audience served; and the management process in accordance with specialized legal regulations.

+ The determination of the number of employees is based on:

++ The job positions and the actual workload at each job position of the public service provider;

++ The level of modernization of offices, equipment, and working tools, and the application of information technology;

++ The current state of management and use of the allocated staff number of the unit.

+ The determination of the structure of public employees in terms of professional titles is based on:

++ The list of job positions;

++ The complexity of the work at the job positions;

++ Standards and professional titles of public employees corresponding to the job positions.

Therefore, determining job positions, number of employees, and the structure of public employees according to professional titles in public service providers must ensure scientific, objective, public, transparent, and effective processes, and enhance the quality of public employees and employees.
