Vietnam’s regulations on use of land for rail transport

According to the Law on Railway Transport 2017 of Vietnam, land for rail transport includes: land for construction of railway works; land within the safety perimeter of the railway work; land within the railway safety corridor.

According to the Law on Railway Transport 2017 of Vietnam, use of land for rail transport shall be specified as follows:

- Land for rail transport shall be used for construction of railway works and ensure rail transport safety according to the land use plan and planning approved by a competent authority;

- In the cases where part of the land area for rail transport must be used to construct essential works in service of national defense and security or socio-economic development, such works must not affect the railway work and rail transport safety and must be licensed in accordance with regulations of the Minister of Transport;

- An organization or individual that is allocated, leased out or transferred railway infrastructure shall use the land for rail transport according to the planning approved by a competent authority and regulations of law.

It is not allowed to use land within the land area reserved for railways in the following cases:

- Building architectural works, planting trees to obscure the view of road users within the railway traffic safety corridor;

- Building works not related to railway tunnel works in urban areas in the region are not allowed to build other works specified at Point a Clause 2 Article 11 of Decree No. 56/2018/NĐ-CP of Vietnam’s Government.

The Law on Railway Transport 2017 of Vietnam officially takes effect from July 01, 2018.
