According to Vietnam’s regulations, requisitioned property shall be returned upon the expiration of the requisition period as stipulated in the decision on the requisition of property. What exactly are these regulations?

According to Article 33 of the Law on compulsory purchase and requisition of property 2008 of Vietnam, the decision to return requisitioned property must be made in writing and include the following main contents:

- Name, address of the organization, full name and address of the individual entrusted with the management and use of the requisitioned property;

- Name, address of the owner of the requisitioned property or the person who legally manages and uses the property;

- Name, type, quantity, and condition of each property to be returned;

- Time and place of the property's return.

Besides, the law also stipulates the participants involved in the return of requisitioned property, including:

- Individuals or representatives of organizations entrusted with the management and use of the requisitioned property.

- The owner of the requisitioned property or their legal representative, or the person who legally manages and uses the property.

The process of returning requisitioned property must be documented in a written record. The essential contents of the record include:

- Name, address of the owner of the requisitioned properties, their legal representative, or the person who legally manages and uses the requisitioned property.

- Name, address of the organization, full name and address of the individual entrusted with the management and use of the requisitioned property.

- Name, type, quantity, and condition of each property to be returned.

- Time and place of the property's return.

In the event that the owner of the requisitioned property or the person who legally manages and uses the property does not come to receive the property, the organization or individual entrusted with the management and use of the requisitioned property shall continue to manage them. The property shall be handled in accordance with the provisions of civil law.

If the owner of the requisitioned property voluntarily donates or gifts the assets to the State, the ownership of the property shall be transferred to the State. The donation or gifting of the property shall be documented in writing.
