Recently, the Government of Vietnam issued Decree No. 216/2013/ND-CP on the organization and activities of inspection in the Planning and Investment sector.
Specifically, according to Article 23 of Decree No. 216/2013/ND-CP of Vietnam’s Government, the handling of overlaps in the inspection activities of the Planning and Investment sector is prescribed as follows:
- If the inspection plan of a lower-level agency overlaps with the plan of a higher-level agency, the lower-level agency shall implement the plan of the higher-level agency.
- The Chief Inspector of the Ministry of Planning and Investment is responsible for overseeing the handling of overlaps in terms of scope, targets, content, and timing of inspections between the Inspectorate of the Ministry of Planning and Investment and the specialized inspection agency of the Planning and Investment sector. They shall coordinate with the Inspectors of other Ministries and equivalent agencies in handling overlaps in the inspection activities of the Planning and Investment sector. They shall also coordinate with the provincial Inspectorate in handling overlaps in the inspection activities of the Planning and Investment sector with local inspection agencies, and report to the Minister of Planning and Investment for review when necessary.
- The Chief Inspector of the Department of Planning and Investment shall report to the Chief Inspector of the province on the handling of overlaps in inspection activities with the local inspection agencies.
