Vietnam’s Circular No. 15/2018/TT-BCT: Responsibilities of relevant agencies and organizations

Circular No. 15/2018/TT-BCT of the Ministry of Industry and Trade of Vietnam on categorization of applicants for preferential Certificate of Origin was issued on June 29, 2018, of which one of the fundamental contents is the regulation on responsibilities of relevant agencies and organizations.

According to Circular No. 15/2018/TT-BCT of the Ministry of Industry and Trade of Vietnam, responsibilities of relevant agencies and organizations are specified as follows:

1. Responsibilities of the Import and Export Department (Ministry of Industry and Trade)

- Prepare and submit documents on categorization of applicants for preferential C/Os to competent authorities for promulgation or self-promulgate those documents as authorized;

- Announce the list of goods going through red channel prescribed in Article 7 herein and cooperate with the Department of E-Commerce and Digital Economy in posting such list on the system of management and issuance of e-C/O.

- Preside over and cooperate with relevant agencies and organizations in managing and solving problems as well as inspecting the categorization of applicants for preferential C/O.

2. Responsibilities of the Department of E-Commerce and Digital Economy (Ministry of Industry and Trade)

- Implement electronic categorization of applicants for preferential C/O on www.ecosys.gov.vn;

- Establish and adjust technical infrastructure serving the electronic categorization;

- Cooperate with relevant agencies and organizations in timely solving problems arising during the categorization.

3. Responsibilities of issuers

- Carry out categorization and instruct traders to make applications for preferential C/O and participate in the pilot categorization program;

- Submit quarterly reports on categorization by issuers to the Import and Export Department (Ministry of Industry and Trade);

- Supervise, notify abnormal situation arising during the issuance of preferential C/O and help traders improve their capacity for compliance with laws;

- Cooperate with the Import and Export Department (Ministry of Industry and Trade) in carrying out physical inspection of goods and inspection visit to production facilities and deal with questions arising during the inspection Where necessary, issuers shall notify the inspection visit to production facilities of traders as the basis for categorization to the Import and Export Department (Ministry of Industry and Trade) for consultancy.

4. Responsibilities of traders

- Strictly comply with laws and acquire knowledge about origin of goods;

- Take legal responsibility for the accuracy and truthfulness of the registered information;

- Provide all documents as required in case the Ministry of Industry and Trade and issuer carry out inspection visits to head offices and production facilities of traders.
