This is a featured content of Circular No. 35/2013/TT-NHNN, issued by the Governor of the State Bank of Vietnam, guiding implementation of a number of provisions on prevention of money laundering.
According to Article 10 of Circular No. 35/2013/TT-NHNN of the State Bank of Vietnam, forms of report with e-data file is specified as follows:
- Report with e-data file is a report presented under the data file transmitted through the transmission line of the State bank of Vietnam.
- Report with e-data file must comply with format, sign, transmission code, file structure under guidelines of the agency of banking inspection and supervision.
- The reporting units must transmit information under the process defined by the State bank of Vietnam and have measures for information security as prescribed in Article 29 of Law on anti-money laundering of Vietnam.
- The reporting units must install software supplied by the Bureau of anti-money laundering, for file transmission.
Time limit for sending reports: Periodically at the end of the working day, the reporting units must sum up the report data and send reports under regulations. Deadline of sending reports will be 16 o’clock of the working day following the day on which the transaction arises. If the following day coincides with holidays, Tet days or weekends, the day of sending reports will be the working day following such holidays, Tet days or weekends. In case of delaying the sending of a report or insufficient report for 2 (two) days or more, the reporting units must provide an explanation for delay or lack thereof to the Bureau of anti-money laundering. In case of detecting mistakes in the sent reports, the reporting units must timely send official dispatch or email to report, and provide explanation for such mistakes to the Bureau of anti-money laundering.
Moreover, the reporting units must register in writing with the Bureau of Anti-money laundering about officers in charge of report with e-data file, including information: Full name, position, address of working place, telephone number, email address and must notify in writing when changing information of officers in charge or changing other officers in charge.
