Vietnam: Responsibilities of vehicles operators and people directly involved in traffic accidents

According to the Draft Law on ensuring road traffic order and safety of Vietnam, vehicle operators and people directly involved in traffic accidents have the following responsibilities:

- Stop the vehicle immediately without causing additional danger to traffic activities; the parties involved in the traffic accident must behave peacefully, fulfill their responsibilities and be ready to help each other in order to limit the damage caused by the traffic accident, must not commit acts of disorderly conduct at the scene of a traffic accident;

- Ensure traffic safety at the area where traffic accidents occur, keeping the scene intact; give first aid to the victim and notify the traffic accident to the nearest police agency, and be present at the request of the competent authority;

- Stay at the place where the traffic accident occurs until the people of the police agency arrive, unless the driver of the vehicle is also injured and must be taken to the emergency room, or the victim must be taken to the emergency room or for life-threatening reasons, but must immediately call the police office or directly report to the nearest police agency or people's committee at the commune, ward or township level or return to the scene when the police arrive at the scene, unless the police allow them to leave;

- Provide identifying information, the person involved in the traffic accident and the authentic information of the traffic accident to the competent authority.

Concurrently, those present at the place where the traffic accident occurs have the following responsibilities: Protect the scene; Timely help and rescue the victims; Immediately notify the nearest police, health or People's Committee; Protect the property of the victim; Provide information and authentic images about the traffic accident at the request of the competent authority.
