On May 16, 2018, the Government of Vietnam issued the Decree No. 79/2018/NĐ-CP providing guidelines for implementation of the Law on management and use of weapons, explosives and combat gears.
Specifically, according to Article 20 of the Decree No. 79/2018/NĐ-CP of Vietnam’s Government, the Ministry of National Defense has the responsibilities to assist the Government in performing uniform management of weapons, military explosives and combat gears for military and national defense purposes; perform state management of weapons, military explosives and combat gears in accordance with regulations of the Law on Management and Use of Weapons, Explosives and Combat Gears and other relevant regulations of law, to be specific:
- Request the Government to promulgate and amend or within its power, promulgate legislative documents on management and use of weapons, military explosives and combat gears as prescribed by the Law on Management and Use of Weapons, Explosives and Combat Gears;
- Perform state management of weapons, military explosives and combat gears under the management of the Ministry of National Defense;
- Prescribe the equipment, management and use of weapons, military explosives and combat gears used by the People’s Army, militia and self-defense forces, Coast Guard and cipher forces under the management of the Ministry of National Defense;
- Provide training in management and use of weapons, military explosives and combat gears and issue, replace, reissue and revoke licenses for and certificates of management and use of weapons, military explosives and combat gears under the management of the Ministry of National Defense;
- Receive, handle and destroy weapons and military explosives returned by police authorities or organizations/individuals.
- Promulgate technical regulations and standards on warehouses and storage places within its power;
- Cooperate with the Ministry of Public Security in repair, conversion, liquidation or destruction of weapons, military explosives and combat gears.
