Vietnam: Responsibilities of People’s Committee of provinces in fishery development

The Government of Vietnam issued Decree No. 17/2018/ND-CP providing amendments to Decree No. 67/2014/ND-CP on certain fishery development policies on February 02, 2018. A notable content of Decree No. 17/2018/ND-CP is the amendments and amendments to the responsibilities of People’s Committee of provinces and central-affiliated cities (People’s Committee of provinces).

Specifically, according to Clauses 16, 17 Article 1 of Decree No. 17/2018/ND-CP of Vietnam’s Government, which amends Article 10 of Decree No. 67/2014/ND-CP, responsibilities of People’s Committee of provinces in fishery development are as follows:

1. Implement the policies regulated in Decree No. 67/2014/ND-CP within their power.

2. Assign People’s Committees of communes to certify entities eligible for one-off post-investment subsidy as prescribed in Article 4a, entities eligible for subsidy as prescribed in Article 5 and the ones eligible for subsidy as prescribed in Article 7 of Decree No. 67/2014/ND-CP, People’s Committees of district to appraise and request People’s Committees of provinces for approval.

3. Regulate the selling price of fuel, petrol, ice for seafood storage; materials used for minor repair, boats, fishnet kits, freshwater, food and other food supplies shipped by logistical boats for off-shore fishery to sell to off-shore fishing boats, which must adhere to the retailing price on the mainland.

4. Allocate the budget to support fishermen and invest in infrastructural development to serve the purpose of aquacultural development as regulated in Decree No. 67/2014/ND-CP.

5. Based on practical demands and conditions at specific local areas, allocate proper amount of budget, grant additional budget or raise the amount of support to implement the development policies for aquacultural production and trading in these areas other than the policies regulated in Decree No. 67/2014/ND-CP.

6. Based on the reality of these local areas, establish a Steering Board to properly implement the policies on aquacultural development as stipulated in Decree No. 67/2014/ND-CP; choose an experimental entity that implements Decree No. 67/2014/ND-CP and then make widespread use of it throughout these areas.

7. Consider solving the case where a vessel owner is incapable of implementing the project on construction or upgrading of a finished vessel or an owner of the finished fishing vessel is incapable of performing commercial fishing activities and wants to transfer the vessel on the basis of opinions given by lending banks.

8. Instruct functional agencies to determine the annual funding for one-off post-investment subsidy so as to send to the Ministry of Finance for aggregation, balancing and allocation of funding.

9. Inspect the implementation of policy on one-off post-investment subsidy; construction and upgrading of fishing vessels; ensure grant of subsidy to proper entities in a lawful and transparent manner.

10. Instruct relevant provincial departments and agencies to cooperate with local banks in expediting vessel owners who have received loan capital in accordance with regulations of Decree No. 67/2014/ND-CP to pay debts to lending banks on schedule as specified in the signed credit agreement.

11. Submit reports on implementation of policies to the Ministry of Finance and the Ministry of Agriculture and Rural Development on a quarterly basis and at the end of the financial year.
