Vietnam: Request for re-examination of the officials rank promotion exam within 15 days

This is a notable content of the Decree No. 138/2020/NĐ-CP of the Government of Vietnam on recruitment, employment and management of officials, issued on November 27, 2020.

Specifically, according to Article 39 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, within 10 days from the date of completion of the exam marking, the officials grade promotion examination council must report to the head of the agency competent to organize the officials rank promotion exam on the exam marking results; at the same time, publicize results on the website or web portal of the agency competent to organize the officials promotion exam and send a written notice to the officials management agency about the test scores of the official taking the promotion exam to notify the official of the exam.

- Within 15 days from the date of notification of the test scores, the exam-takers have the right to send an application for review of the results of the general knowledge, foreign languages, and computer science tests (in the case of a paper-based multiple-choice test) and professional written exams. The Council for the examination and promotion of officials rank shall set up a review board and organize the evaluation and re-examination, and announce the results of the evaluation and re-evaluation within 15 days from the date of expiry of the time limit for receiving the application for re-examination as prescribed in this Clause.

- Within 05 working days from the date of publication of the re-evaluation result, the Rank-Upgrading Examination Council shall report to the head of the agency competent to organize the officials rank promotion exam to approve the result of the officials rank promotion exam and the list of elected officials.

- Within 05 working days from the date of issuance of the decision approving the results of the officials examination, the Council for the promotion of officials shall be responsible for notifying the examination results and the list of elected officials in writing to the agency managing whose officials participate in the exam.
