Vietnam: Regulatory bodies competent to provide hydrometeorological information and data

Recently, the Government of Vietnam issued Decree No. 48/2020/NĐ-CP amending a number of Articles of Decree No. 38/2016/NĐ-CP dated May 15, 2016 of detailing a number of Articles of the Law on Hydrometeorology.

According to Clause 9 Article 1 of Decree No. 48/2020/NĐ-CP of Vietnam’s Government amending Article 24 of Decree No. 38/2016/NĐ-CP, regulatory bodies, organizations and individuals with competence in provision and verification of hydrometeorological information and data include:

1. Hydrometeorological database management bodies.

2. Public hydrometeorological service providers affiliated to the Ministry of Natural Resources and Environment.

3. Regulatory bodies, organizations and individuals managing specialized hydrometeorological stations.

4. Other regulatory bodies, organizations and individuals owning hydrometeorological information and data that have been inspected and evaluated by competent authorities according to regulations of laws.

Thus, from June đă, 2020, other regulatory bodies, organizations and individuals owning hydrometeorological information and data that have been inspected and evaluated by competent authorities according to regulations of laws.

Moreover, Decree No. 48/2020/NĐ-CP also stipulates that regulations on time limit for hydrometeorological observation and provision of hydrometeorological information and data by owners of the facilities mentioned in Clause 1 Article 1 of this Decree that are in operation and have not had their hydrometeorological elements observed:

- No later than 01 year for medium-sized dams and reservoirs with flood control valves and no later than 02 years for medium-sized dams and reservoirs with uncontrolled spillway after the entry into force of this Decree;

- No later than 02 years after the entry into force of this Decree for wharves; bridges with a clearance of at least 500 meters that do not cross estuaries, straits, bays or inland islands; expressways; general inland ports of class I or higher; and specialized facilities, including islands of the Spratlys, DK1 rigs and military airbases for national defense and security purpose.
