Vietnam: Regulations on the coordination mechanism among local agencies regarding labor

Circular 20/2018/TT-BLDTBXH was issued by the Ministry of Labor, Invalids and Social Affairs of Vietnam, providing guidelines for the coordination mechanism in conducting specialized inspections of labor, safety, and hygiene during night time and outside of regular working hours.

According to Vietnam's new regulations, the coordination of specialized labor inspection is implemented as follows:

- When there is an infringement on the rights of employees or a failure to ensure occupational safety and health at the workplace that, if continued, may affect the rights or endanger the lives of employees, or upon receiving directives from the Chief Inspector of the Ministry of Labor, Invalids, and Social Affairsthe Director of the Department of Labor, Invalids, and Social Affairs must notify relevant local agencies, the police, and the local government in the province.

- The notified agency shall appoint officers to join the inspection team and coordinate in handling the case.

- The Director of the Department of Labor, Invalids, and Social Affairs or the Chief Inspector of the Department of Labor, Invalids, and Social Affairs where the incident occurred shall issue an Inspection Decision within their authority. If necessary, the Chairman of the Provincial People's Committee shall issue an Inspection Decision.

Refer to the responsibilities of the relevant agencies in Circular 20/2018/TT-BLDTBXH of the Ministry of Labor, Invalids, and Social Affairs, effective from January 01, 2019.
