Vietnam: Regulations on position and function of Centers for HIV/AIDS prevention and control

This is a notable content of the Circular No. 02/2015/TT-BYT of the Ministry of Health of Vietnam on functions, tasks, powers and organizational structure of the Centers for HIV/AIDS Prevention and Control in the provinces and central-affiliated cities.

Thông tư 02: Quy định về Vị trí, chức năng của Trung tâm phòng, chống HIV/AIDS, Thông tư 02/2015/TT-BYT

According to the Circular No. 02/2015/TT-BYT of the Ministry of Health of Vietnam, position and function of Centers for HIV/AIDS prevention and control in provinces and central-affiliated cities are specified as follows:

- Centers for HIV/AIDS prevention and control in provinces and central-affiliated cities (hereinafter referred to as Provincial Centers for HIV/AIDS Prevention and Control) are public non-business units under the Department of Health, with the functions: direct and organize the performance of professional and technical tasks on HIV/AIDS prevention and control in the province; organize the implementation of public health services in accordance with law.

- The Provincial Center for HIV/AIDS Prevention and Control has legal status, its own seal and account, and its head office in accordance with the law.

- The Provincial Center for HIV/AIDS Prevention and Control is under the comprehensive and direct direction and management of the organization, operation and resources of the Departments of Health of the provinces and central-affiliated cities; under the direction, examination, inspection and professional guidance of the Ministry of Health.

Besides, Circular No. 02/2015/TT-BYT also stipulates job position and number of people working, specifically as follows:

- Job position, number of people working and structure of public employees by professional title of Provincial Center for HIV/AIDS Prevention and Control are determined on the basis of the employment position scheme of the Center, which is appraised and approved by a competent state agency in accordance with law. In addition to the assigned human resources, the Director of the Provincial Center for HIV/AIDS Prevention and Control is entitled to sign a labor contract to meet the needs of performing tasks and workload as prescribed by law.

- The management and use of human resources of the Provincial Center for HIV/AIDS Prevention and Control shall comply with the provisions of law.
