Vietnam: Regulations on contracts related to the Science and Technology Program (Illustrative image)

Under Circular 19/2011/TT-BKHCN, the regulations on contracts related to the Science and Technology Program in Vietnam are as follows:

1. Contract conclusion

- The Program Steering Committee and the Program Office sign Implementation Contracts of the themes and projects with the host organization and leader. The contract template is issued by the Ministry of Science and Technology of Vietnam.

- Annually, the Ministry of Science and Technology of Vietnam assigns tasks and guides the content and plans of the Program to the Program Steering Committee and Office while notifying this content to the managing ministry (for tasks led by its subordinate agencies) in the general plan for science and technology of the managing ministry.

2. Termination of contracts

- The Ministry of Science and Technology of Vietnam, based on the proposal of the Program Office, Program Steering Committee, host organization, reviews and decides on the termination of contract implementation in the following cases:

- The themes or projects encounter objective circumstances leading to the inability to complete the approved content and objectives;

- The leader and host organization cannot manage, organize, and implement the themes or projects; the research direction of the themes or projects is deadlocked or no longer needed;

- Contract violations: conditions stipulated by the contract are not guaranteed, leading to the inability to complete the themes or projects; the themes or projects are not implemented according to the research content stated in the concluded contract; funds are misused.

- Based on the decision to terminate contract implementation, the Program Steering Committee, Program Office, host organization, and leader shall carry out the contract liquidation procedures as per the contractual terms agreed by the parties and the legal regulations on contracts.

3. Contract liquidation

The Program Steering Committee and the Program Office shall proceed with contract liquidation with the host organization and leader according to current regulations. In case the conditions for liquidation are met, and the Program Steering Committee has already concluded its term, the Program Office shall proceed with the contract liquidation with the host organization and leader. The contract liquidation form is issued by the Ministry of Science and Technology of Vietnam.
