Vietnam: Regulation on potentially unsafe products and goods

On May 15, 2018, the Government of Vietnam issued Decree No. 74/2018/NĐ-CP providing amendments and supplements to a number of articles of Decree No. 132/2008/ND-CP detailing the implementation of a number of articles of the Law on Products and Goods Quality.

According to Decree No. 74/2018/NĐ-CP of Vietnam’s Government, potentially unsafe products and goods shall be determined as follows:

1. Rules of identification of potentially unsafe products and goods shall be established on the following bases:

- The capability of causing unsafety of products and goods.

- Regulatory requirements and competences over time periods.

2. The capability of causing unsafety of products and goods shall be determined based on one or a number of factors as follows:

- Chemical, physical, and biological nature;

- Functional structure and principles;

- Transportation, warehousing, storage and usage.
