Vietnam: Regiment-level finance authority shall archive documents for receiving occupational accidents and diseases benefits of military servicemen

On October 29, 2020, the Ministry of Defense of Vietnam issued Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense.

Regiment-level finance authority shall archive documents for receiving occupational accidents and diseases benefits of military servicemen (Illustration)

According to Article 19 of Circular 136/2020/TT-BQP stipulates, the process and responsibilities for resolving occupational accident and disease benefits for military personnel; cipher workers enjoying salaries equivalent to military personnel; national defense officials, workers, and public employees; and contract workers in agencies, units, and enterprises under the Ministry of National Defense (hereinafter referred to as employees) as follows:

* For Employees

  • Employees experiencing their first occupational accident or disease, or undergoing a comprehensive examination:

    • Submit documentation as guided in clauses 1, 4, 5, 6, and 11 of Article 13 for occupational accident benefits; or documentation as guided in clauses 1, 3, 4, and 10 of Article 14 for occupational disease benefits; or documentation as guided in clauses 1, 3, 5, and 9 of this Circular for a comprehensive assessment of reduced working capacity, to the regiment-level personnel department.
    • If eligible for payment to purchase assistive devices and prosthetic tools, additional documentation as guided in clause 2 of Article 17 of this Circular is required.
  • Employees with recurring occupational injuries or diseases: Submit documentation as guided in clauses 1, 3, 5, 6, and clause 10 of Article 15 to the regiment-level personnel department managing them.

* For Employers

  • Regiment-level personnel department and equivalent:

    • Guide employees in submitting their documents; receive, check, and verify the consistency of personal information between social insurance records and the employee’s birth certificate, national ID (or citizen identification), and household registration.
    • Fully update the employee’s social insurance records with contributions up to the month immediately before the occupational accident or disease occurred, or up to the month immediately before the Medical Assessment Council’s conclusion (in cases where there was no leave for treatment or if the discharge date is undetermined).
    • Coordinate with functional agencies to complete the dossier as per regulations and submit to higher-level personnel departments along with benefit records.
    • Receive resolved records from higher-level personnel departments and hand them to employees.
  • Higher-level personnel departments equivalent to and above regiments:

    • Receive benefit dossiers for occupational accidents and diseases from lower-level personnel departments, check, verify, and complete documentation as per guidelines in Articles 13, 14, 15, 16, and 17 of this Circular and submit to the Ministry’s personnel department. Aggregate and send the Ministry of National Defense's Social Insurance Office the benefit dossiers for each employee along with records. Receive resolved records from the Ministry of National Defense's Social Insurance Office and hand them to the relevant units to be given to employees.
  • Regiment-level financial authority and equivalent:

    • Receive occupational accident and disease benefit decisions resolved by the Ministry of National Defense's Social Insurance Office, submitted by the personnel department or employees; check and prepare full and timely disbursement lists as per form 05/BHXH issued with Circular 37/2017/TT-BQP.
    • Quarterly and annually compile and report on settlements (along with other social insurance expenses) to higher-level financial departments and the Ministry of National Defense's finance department.
    • Archive documents and receipts as regulated.
