There are 09 occasions on which State-level memorial ceremonies for President Ho Chi Minh will be held. This is the content proposed in the Draft Ordinance on the Management and Protection of the Mausoleum of President Ho Chi Minh.

Article 18 of the Draft Ordinance on the Management and Protection of President Ho Chi Minh's Mausoleum Complex (hereinafter referred to as the Draft Ordinance) stipulates 03 types of Memorial Ceremonies for President Ho Chi Minh and the responsibilities of the Mausoleum Management Board:
- Memorial ceremonies for President Ho Chi Minh conducted at President Ho Chi Minh's Mausoleum include:
+ State-level Memorial Ceremony;
+ Memorial ceremonies for high-level foreign guests;
+ Regular memorial ceremonies.
- The Mausoleum Management Board of President Ho Chi Minh is responsible for:
+ Coordinating with related agencies to organize the memorial ceremonies specified in Points a and b, Clause 1, Article 18 of the Draft Ordinance;
+ Leading the organization of the memorial ceremony specified in Point c, Clause 1, Article 18 of the Draft Ordinance.
Article 19 of the Draft Ordinance stipulates the timing for organizing regular Memorial Ceremonies, State-level Memorial Ceremonies, and not holding the memorial ceremony. Specifically:
- Weekly, regular memorial ceremonies are held in the mornings of Tuesday, Wednesday, Thursday, Saturday, and Sunday; the memorial is closed on the mornings of Monday and Friday.
- The following days, if falling on a Monday or Friday, regular memorial ceremonies are still held:
+ Lunar New Year's Day;
+ Victory Day, April 30;
+ President Ho Chi Minh's Birthday, May 19;
+ National Day, September 2.
- Annually, for a period of 2 to 3 months, the memorial ceremony will not be held for medical work to preserve President Ho Chi Minh's remains and regular maintenance; the specific time is decided by the Prime Minister of the Government of Vietnam based on the proposal of the Head of the Mausoleum Management Board of President Ho Chi Minh and widely announced on mass media. Weekly, the memorial is not organized on Mondays and Fridays to fulfill medical work to preserve President Ho Chi Minh's remains. Other cases of stopping the memorial ceremony are decided by the Prime Minister of the Government of Vietnam based on the proposal of the Head of the Mausoleum Management Board of President Ho Chi Minh.
State-level Memorial Ceremony is organized on the following occasions:
+ Lunar New Year;
+ Anniversary of the founding of the Communist Party of Vietnam, February 3;
+ Victory Day, April 30;
+ President Ho Chi Minh’s Birthday, May 19;
+ Martyrs and Invalids Day, July 27;
+ August Revolution Day, August 19 and National Day, September 2;
+ Anniversaries marking significant milestones of the Dien Bien Phu Victory, May 7;
+ National Congress of the Communist Party of Vietnam;
+ National Assembly sessions.
- Memorial Ceremony timing for President Ho Chi Minh within the day is regulated as follows:
+ From April 1 to October 31:
++ Tuesday, Wednesday, Thursday: From 7:30 AM to 10:30 AM;++ Saturday, Sunday, and holidays: From 7:30 AM to 11:00 AM.
+ From November 1 to March 31 the following year:
++ Tuesday, Wednesday, Thursday: From 8:00 AM to 11:00 AM;++ Saturday, Sunday, and holidays: From 8:00 AM to 11:30 AM.
- The extension of the Memorial Ceremony timing for President Ho Chi Minh within the day is decided by the Head of the Mausoleum Management Board of President Ho Chi Minh, but it must ensure the requirements for the long-term preservation and absolute safety of President Ho Chi Minh's remains.
