Vietnam: Promulgating regulations on construction supervision

According to Circular No. 26/2016/TT-BXD of the Ministry of Construction of Vietnam, depending on each monitoring element, there will be corresponding monitoring contents, specifically as follows:

1. Construction quality supervision:

The construction quality supervision shall conform to clause 1 Article 26 of Decree No. 46/2015/ND-CP of Vietnam’s Government.

2. Supervision of construction progress:

- Inspect and verify the overall and detailed progress of construction of work items to assure that it is consistent with the approved progress.

- Carry out on-site inspection and accelerate construction activities implemented by the construction contractor. Petition the investor to request the construction contractor to endeavor to achieve the construction progress, where necessary;

- Assess and determine causes for the delay and notify the investor in writing for consideration of adjustment to the construction progress in case the overall progress is slow down;

- Verify the construction contractors ‘actual capacity, its manpower, construction equipment according to the construction contract; and propose construction measures to keep up with the progress.

3. Construction workload supervision:

- Inspect and verify the accepted workload under regulations of laws;

- Notify the investor of the increased workload according to the construction contract.

4. Supervision of occupational safety and environmental protection:

Supervise the compliance with regulations on management of occupational safety and environmental protection in the process of construction as stipulated in Article 34, Article 35 of Decree No. 59/2015/ND-CP of Vietnam’s Government and regulations on occupational safety and environmental protection.
