Vietnam: Professional measures to prevent criminal activities in the prevention and combating of human trafficking

On June 25, 2013, the Ministry of National Defense of Vietnam issued Circular No. 78/2013/TT-BQP regulating measures for the Border-Guard Command and Coast Guard in preventing and combating human trafficking.

According to Article 6 of Circular No. 78/2013/TT-BQP of the Ministry of National Defense of Vietnam, professional preventive measures performed by the Border-Guard Command and Coast Guard in the prevention and combating of human trafficking are specified as follows:

- Implement preventive measures according to the regulations of the law to detect and prevent acts of human trafficking and other violations of laws on prevention and combating of human trafficking.

- Conduct research and assessment of the situation, determine causes and conditions that lead to human trafficking crimes in the managed areas to proactively take preventive measures and fight against the causes and conditions for committing human trafficking offenses.

- Coordinate with relevant agencies and local authorities to manage, educate, and deter offenders, individuals involved in human trafficking crimes, as well as individuals with prior convictions related to human trafficking in border, sea, and island areas.

- Organize the reception and verification of information, documents, and reports on human trafficking crimes provided by agencies, organizations, and individuals in accordance with the provisions of the Criminal Procedure Code, the Complaints Law, the Denunciation Law, and laws on prevention and combating of human trafficking.

- Strengthen patrol and control activities of borders, checkpoints, sea and island areas to timely detect and prevent the activities of human trafficking criminals.

- Coordinate with functional agencies to manage security and order in border, sea, and island areas; manage population, household registration, temporary residence, accommodation, and temporary absence; manage business and service activities to prevent human trafficking.

- Research and propose improvements to the domestic legal system and international cooperation related to the functions and tasks of the Border-Guard Command and Coast Guard in the prevention and combating of human trafficking.
