Vietnam: Procedures for notification and periodic reporting in the new Draft Decree

This is a notable content of the Draft Decree amending a number of articles of Decree No. 181/2013/NĐ-CP of Vietnam’s Government on elaboration of some articles of the Law on Advertising.

According to the Draft Decree mending a number of articles of Decree No. 181/2013/NĐ-CP of Vietnam’s Government, procedures for notification and periodic reporting are as follows:

First, foreign entities in providing cross-border advertising services in Vietnam shall carry out procedures to notify the Ministry of Information and Communications of the following contact information:

- Name of the registered organization, transaction name, name of the country where the organization's operations are registered or name of the individual providing the service;

- Address of the organization's headquarters or permanent residence address, nationality of the individual who owns the website and location of the main server system providing the service;

- Contact points of foreign organizations and individuals and contact points in Vietnam include: name of organization, individual, email address, contact phone number;

- Foreign organizations and individuals send notices to the Ministry of Information and Communications in one of the following forms: Sending notices directly, by post or via the Internet.

Secondly, foreign entities in providing cross-border advertising services in Vietnam shall make regular reports every 12 months on December 15 or irregular reports as required on activities providing cross-border advertising services in Vietnam to the Ministry of Information and Communications (Authority of Broadcasting and Electronic Information) using Form No. 01 enclosed with this Decree or make an irregular report at the request of a competent state management agency regarding advertising activities on cross-border advertising service provision platforms.

Thirdly, advertising service providers shall make a regular report every 12 months on December 15 or make an irregular report to the Ministry of Information and Communications (Authority of Broadcasting and Electronic Information) using Form No. 02 enclosed with this Decree or make an irregular report at the request of a competent state management agency regarding advertising activities on cross-border advertising service provision platforms.
