Vietnam: Procedures for dissolution of victim assistance facilities and counseling centers on domestic violence

This is one of the important contents stipulated in Circular 23/2014/TT-BVHTTDL on amendments to Circular 02/2010/TT-BVHTTDL, issued on December 22, 2014 in Vietnam.

Regarding the authority to assistance facilities for domestic violence victims; counseling facilities on domestic violence prevention and control in Vietnam, Clause 1, Article 8 Circular 02/2010/TT-BVHTTDL is amended as follows:

1. The agency authorized to issue the Certificate of Operation Registration as stipulated in Article 17 Decree 08/2009/ND-CP is the agency authorized to dissolve counseling facilities on domestic violence prevention and control; assistance facilities for domestic violence victims in the following cases:

a) Upon the proposal of counseling facilities on domestic violence prevention and control or the assistance facilities for domestic violence victims;

b) Having the Certificate of Operation Registration revoked or having the right to use the Certificate of Operation Registration withdrawn as decided by the competent authority.

Before dissolving, assistance facilities for domestic violence victims; counseling facilities on domestic violence prevention and control in Vietnam must fulfill all financial and asset obligations as prescribed by law.

Upon dissolution, the facility must cease all activities upon receiving the Dissolution Decision from the competent authority.

Within 15 working days from the date of issuance of the Dissolution Decision or 7 working days from the date of receipt of the Dissolution Decision as stipulated in Point a, Clause 1, Article 8 Circular 02/2010/TT-BVHTTDL, the assistance facilities for domestic violence victims; counseling facilities on domestic violence prevention and control must submit the Certificate of Operation Registration to the issuing agency to remove the name from the Register.
