Vietnam: Principles of compulsory purchase and requisition of property

The Law on compulsory purchase and requisition of property 2008 of Vietnam regulates the process of compulsory purchase and requisition of property; rights and responsibilities of state agencies in carrying out the compulsory purchase and requisition of property; etc. The law also establishes certain principles of compulsory purchase and requisition of property.

Specifically, according to the Law on compulsory purchase and requisition of property 2008 of Vietnam, the compulsory purchase and requisition of property must comply with the following principles:

One, the compulsory purchase and requisition of property shall only be carried out when it is genuinely necessary for reasons of national defense, security, and national interest.

Two, the compulsory purchase and requisition of property must ensure the lawful rights and interests of the property owners and must not discriminate.

Three, the compulsory purchase and requisition of property shall be carried out based on the decision of the competent authority and must comply with the conditions, procedures, and regulations stipulated in this Law.

Four, the owners of the property subject to compulsory purchase and requisition must comply with the decision of the competent authority.

Five, the management and use of the property subject to compulsory purchase and requisition must be in accordance with the intended purpose, cost-effective, and efficient.
