Vietnam: Power to issue decisions on the disposal of state property within the Ministry of National Defense removed from the property distribution

According to Article 15 of Circular 126/2020/TT-BQP, the power to issue decisions on the disposal of state property within the Ministry of National Defense of Vietnam removed from the property distribution in Vietnam is specified as follows:

1. The Minister of National Defense shall issue decisions on the disposal of the following state property:

- Various types of guns and cannons;

- Radar systems, missile complexes, missiles, aircraft;

- Tanks, armored vehicles;

- Ships (combat ships, auxiliary ships, combat training ships, combat boats); water transport vehicles with a capacity of 50 tons or more;

- Automobiles; specialized motorcycles; engineering motorcycles;

- Recovered items after ammunition processing;

- Equipment and goods in the reserves at the Ministry of National Defense of Vietnam's depots and sectoral depots as per management levels;

- Grades I and II houses;

- Steel tanks with a capacity of over 50 m3.

2. The Chief of General Staff shall issue decisions on the disposal of state property which includes ammunition and hazardous chemicals.

3. Commanders of agencies or units under the Ministry of National Defense of Vietnam shall issue decisions on the disposal of state property other than those specified in Items 1 and 2 of this Article that are assigned for management and use by competent authorities.

4. Power to disposal of Category 5 dangerous ammunition with safety risks requiring urgent processing:

- In cases where Category 5 ammunition is dangerous, poses safety risks, and needs urgent processing, the Depot Chief or Regiment Commander and equivalents conduct inspections and decide on disposal to ensure safety according to current regulations issued by competent authorities. After disposal and record making, a report is promptly compiled and sent to the immediate superior authority and the Commanders of agencies or units under the Ministry of National Defense of Vietnam;

- No later than 07 days after processing, agencies or units under the Ministry of National Defense of Vietnam must provide a written report on the results of disposal of Category 5 dangerous ammunition with safety risks requiring urgent processing to the Ministry of National Defense of Vietnam and request the Chief of General Staff to issue a decision on removal from the property distribution.
