Vietnam: Plan for formation and issuance of guiding documents for the Law on Water Resources 2023 (Internet image) 

On April 2, 2024, the Prime Minister of Vietnam issued Decision 274/QD-TTg on the implementation plan for the enforcement of the Law on Water Resources 2023.

Plan for formation and issuance of guiding documents for the Law on Water Resources 2023 in Vietnam

The Law on Water Resources 2023 passed by the 6th Session of the 15th National Assembly on November 27, 2023, and will come into effect on July 1, 2024. To timely, comprehensively, uniformly, and effectively implement the Law on Water Resources 2023, the Prime Minister issued a plan for the implementation of the Law on Water Resources 2023, which includes the following contents regarding the formation and issuance of documents detailing and guiding the enforcement of the Law on Water Resources 2023:

(1) Formation of documents according to Decision 19/QD-TTg dated January 8, 2024, of the Prime Minister on the issuance of the List and assignment of agencies in charge of drafting detailed regulations for the enforcement of laws and resolutions passed by the 15th National Assembly at its 6th Session.

- Agency in charge of formation: Ministry of Natural Resources and Environment.

- Submission time: April 2024.

(2) Formation of a Decree regulating administrative sanctions in the field of water resources in accordance with Resolution 01/NQ-CP dated January 5, 2024, of the Government on the main tasks and solutions for implementing the Economic - Social Development Plan and State Budget Estimate for 2024.

- Agency in charge of formation: Ministry of Natural Resources and Environment.

- Submission time to the Government: December 2024.

(3) Formation of a Decree stipulating the production, supply, and consumption of domestic water as regulated in Article 43, Clause 5 of the Law on Water Resources 2023.

- Agency in charge of formation: Ministry of Agriculture and Rural Development and Ministry of formation by the assigned state management function.

- Submission time to the Government: Before 2026.

(4) Review and issuance of other legislative documents assigned in the Law on Water Resources 2023.

- Documents with content regulating standards, technical regulations to ensure safe and efficient water use, reduce water loss rate (based on point b, Clause 3 of Article 43 of the Law on Water Resources 2023):

+ Agency in charge of formation: Ministry of formation.

+ Implementation time: From 2024 to 2026.

- Documents with content regulating national technical standards for clean water quality used for domestic purposes (based on point b, Clause 3 of Article 43 of the Law on Water Resources 2023):

+ Agency in charge of formation: Ministry of Health.

+ Implementation time: From 2024 to 2026.

- Documents with content regulating national technical standards for planning and infrastructure formation to enhance water permeability, storage, drainage, ensure underground water replenishment, and prevent flooding (based on Clause 8 of Article 63 of the Law on Water Resources 2023):

+ Agency in charge of formation: Ministry of formation.

+ Implementation time: From 2024 to 2026.

- Documents with content regulating standards, technical regulations for formation works (based on Clause 5 of Article 66 of the Law on Water Resources 2023):

+ Agency in charge of formation: Ministry of formation and Ministry of Transport.

+ Implementation time: From 2024 to 2026.
