When applying for a job, most organizations require candidates to provide a complete set of documents including a résumé, identification card, household registration book, various degrees, and other related documents, which often must be notarized and authenticated. The question that arises is where to go to get these documents authenticated?
First, regarding the authentication of Personal Resume?
It can be seen that a resume is considered a declaration of one's personal background, including the most basic information about an individual. For this type of document, the requirement for authentication (or confirmation) is only carried out through signature authentication.
Specifically, on March 20, 2014, the Department of Civil Status, Nationality, Authentication issued Official Dispatch 1520/HTQTCT-CT guiding the confirmation of resumes. The commune-level People's Committees in the area only authenticate the signature of the person declaring the resume; the declarant must take responsibility for the information declared in the resume. In case the authenticator of the commune-level People's Committee knows well about the background of the declarant and has confidence in the declared contents, they can confirm the accuracy of the resume content. It is recommended that the commune-level People's Committees do not record information regarding the observance of laws, policies, and directives of the State and localities in the resumes of citizens.
Subsequently, on August 25, 2017, the Department of Civil Status, Nationality, Authentication issued Official Dispatch 873/HTQTCT-CT on thoroughly implementing the authentication of resumes. The Department of Civil Status, Nationality, Authentication requested the Departments of Justice of provinces and central-affiliated cities to continue disseminating, thoroughly directing all competent authentication agencies and organizations in the area (including commune-level People's Committees, Justice Divisions under district-level People's Committees, and notary public organizations) to absolutely not comment on the observance of guidelines, laws, policies, and regulations of the Communist Party, State, and localities in the resumes of citizens; only to authenticate the signature of the person requesting on the resume in compliance with Clauses 3, Articles 23 to 26 of Decree No. 23/2015/ND-CP.
At the same time, Item 7 of Official Dispatch 1352/HTQTCT-CT of 2015, Article 24 of Decree 23/2015/ND-CP also clearly stipulates the cases of signature authentication, including the authentication of personal resume signatures. To be specific:
Article 24. Signature Authentication Procedure … 4. The signature authentication procedures stipulated in Clauses 1, 2, and 3 of this Article also apply to the following cases: a) Authentication of multiple signatures in the same paper or document; b) Authentication of the signature of the person declaring personal resume; c) Authentication of signatures in papers and documents personally prepared according to legal regulations; d) Authentication of signatures in Authorization Letters in cases of gratuitous authorization, with no compensation and not involving the transfer of property ownership rights, land use rights. |
According to Article 5 of Decree 23/2015/ND-CP regarding authentication authority:
Article 5. Competence and Responsibility to Authenticate 1. District-level Justice Divisions, district, district-level town, city under the province (hereinafter referred to as Justice Divisions) are competent and responsible to: a) Authenticate copies from originals of papers and documents issued by competent agencies and organizations of Vietnam; competent agencies and organizations of foreign countries; or competent agencies and organizations jointly issued by Vietnam and foreign competent agencies and organizations; b) Authenticate signatures in papers and documents; ... 5. The authentication of copies from originals, signature authentication, contract authentication, transaction authentication related to movable property, and will authentication stipulated in this Article regardless of the place of residence of the person requesting authentication. |
Additionally, according to Item 1 of Official Dispatch 1352/HTQTCT-CT of 2015, for signature authentication, both Justice Divisions and commune-level People's Committees are equally competent, regardless of the language of the documents.
Thus, according to these regulations, a personal resume can have its signature authenticated at any competent authority, either at the district-level Justice Division or the commune-level People's Committee anywhere within Vietnam's territory, not necessarily at the place of permanent residence registration, and the person requesting authentication is responsible for the content of the papers or documents they sign when requesting signature authentication.
For other documents such as: University Diploma, College Diploma, Foreign Language Certificates (TOEIC, TOEFL), etc., where should the authentication be done?
According to Article 5 of Decree 23/2015/ND-CP, the authentication competence for various types of papers and documents is as follows:
1. District-level Justice Divisions, district, district-level town, city under the province (hereinafter referred to as Justice Divisions) are competent and responsible to: a) Authenticate copies from originals of papers and documents issued by competent agencies and organizations of Vietnam; competent agencies and organizations of foreign countries; or competent agencies and organizations jointly issued by Vietnam and foreign competent agencies and organizations; … 2. Commune-level People's Committees, commune, ward, commune-level town (hereinafter referred to as commune-level People's Committees) are competent and responsible to: a) Authenticate copies from originals of papers and documents issued by competent agencies of Vietnam; … |
Thus, for university and college diplomas, foreign language certificates, or various types of certificates issued by foreign competent agencies, or by Vietnamese competent agencies in cooperation with foreign competent agencies, they must be authenticated at district-level Justice Divisions. Meanwhile, for university and college diplomas or foreign language certificates, certificates issued by Vietnamese agencies, they can be authenticated at commune-level People's Committees. And according to Clause 5, Article 5 of Decree 23/2015/ND-CP, the authentication of these types of documents is not required to be done at the place of permanent residence registration but can be authenticated at any competent authority.
