Vietnam: Penalties for destruction of the works serving the forest protection

According to Decree No. 157/2013/NĐ-CP of Vietnam’s Government, the works for the protection and development of forests include: station, fire watch tower, signal, protecting forest panel; fence, forest boundary; tank, water reservoir for wildfire fighting; vehicle, tool used for the protection and development of forests.

People who cause damage to the above-mentioned works, cause change or damage to these works shall be liable to:

- Warnings or fines of from VND 100,000 to VND 300,000 shall be imposed for: writing, drawing onto the signs, forest protection propagation boards; erasing the information or pictures on the signs, forest protection propagation boards.

- Fines of from VND 300,000 to VND 3,000,000 shall be imposed for removal of forest protection signs.

- Fines of from VND 5,000,000 to VND 10,000,000 shall be imposed for:

+ Destroying the forestry roads.

+ Obstructing the patrolling serving forest protection and poacher arrest.

+ Destroying the fire obstacles.

+ Destroying forest perimeter fences, landmarks.

- Fines of from VND 10,000,000 to VND 20,000,000 shall be imposed for destroying propaganda boards of forest protection, sentry boxes, working places, and other vehicles, instruments and properties used for forest protection.

In addition to the above fines, the violating entities shall be compelled to restore destroyed or damaged protective works to their original condition according to the Law on handling administrative violations 2012 of Vietnam.
