Vietnam: Participants in revolutions before January 01, 1945 shall not be recognized

This is a notable content of the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 issued by the Standing Committee of National Assembly of Vietnam on December 09, 2020.

According to Article 53 of the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam, persons in following cases are not considered for recognition of people with meritorious services to the revolution:

(1) Participating in activities against the regime, the Party and the State; desertion, betrayal, participating in the Open Arms program; is serving a definite prison sentence but is not entitled to a suspended sentence, life imprisonment, death penalty or is convicted of one of the crimes of infringing upon national security; deprived of military title or people's police title;

(2) Death, injury, illness of self-inflicted; violate the law, violate the regulations of agencies and units; due to an accident not caused by the conduct of the offender.

(3) Not considering recognition as revolutionary activists before January 01, 1945, people who were active in the revolution from January 01, 1945 to the date of the August insurrection 1945 for those who were expelled from the Party.

Thus, it can be seen that there are 03 cases that are not considered for recognition of people with meritorious services to the revolution from July 01, 2021. In particular, those who were active in the revolution before January 01, 1945 or those who were active in the revolution from January 01, 1945 to the date of the August uprising in 1945, who were expelled from the Party, will not be considered for recognition of people with meritorious services to the revolution.

In addition, those with meritorious services to the revolution who participated in activities against the regime, the Party/State; desertion, betrayal, or participating in the Open Arms program shall be terminated from the preferential regime. Concurrently, those who were active in the revolution before January 01, 1945, and those who were active in the revolution from January 1, 1945 to the date of the August uprising in 1945, who were expelled from the Party, shall have their privileges terminated from the date of expulsion.
