Vietnam: Papers and documents proving legal residence to register permanent residence

According to Clause 1 Article 6 of Decree No. 31/2014/NĐ-CP of Vietnam’s Government, papers and documents proving legal residence for permanent residence registration are one of the following:

- Firstly, papers and documents proving that the legal residence belongs to the citizen are one of the following:

+ Certificate of housing ownership or housing ownership documents issued by competent authorities over time;

+ Documents on residential land use rights according to the provisions of land law (already have a house on that land);

+ Construction permit according to the provisions of construction law (for cases where a permit must be issued);

+ State-owned housing purchase and sale contract or documents on liquidation price of state-owned housing;

+ Housing purchase contract or documents proving the handover of housing or receipt of housing from an enterprise with the function of trading in housing investment and construction for sale;

+ Documents on buying, selling, donating, donating, exchanging, or inheriting housing notarized or authenticated by the People's Committee of the commune, ward or town (hereinafter referred to as the Commune People's Committee);

+ Documents on handing over gratitude houses, charity houses, great solidarity houses, housing and residential land to immigrant individuals and households according to the State's plans or other subjects;

+ Documents from the Court or state administrative agency competent to resolve housing ownership that are legally effective;

+ Documents certified by the Commune People's Committee on housing and residential land with no dispute over housing ownership or residential land use rights if one of the above documents is not available;

+ Documents proving the registration of ships, boats, and other vehicles under ownership and the original dock address of the vehicle used for residence. In case there is no registration paper, there needs to be confirmation from the Commune People's Committee that there is a ship, boat or other vehicle used for living under ownership or confirmation of the purchase, sale, donation, exchange, or inheritance of a ship, boat, or other vehicle and the original docking address of that vehicle.

- Secondly, papers and documents proving the legal lease, loan, or stay at a place of residence are documents on the lease, loan, or stay at a house or other house of an agency, organization, or individual (in case of documents for renting, lending, or letting people stay in houses or other houses of individuals, they must be notarized or authenticated by the commune-level People's Committee). For houses and other houses in central-affiliated cities, there must be confirmation from the Commune People's Committee on the average area conditions as prescribed by the People's Council of the central-affiliated city and written consent from the person renting, lending, or staying;

- Thirdly, documents from agencies, organizations, and religious establishments on citizens having accommodation in the cases specified in Point c and Point d, Clause 1, Article 26 of the Law on Residence of Vietnam;

- Fourthly, Documents of agencies and organizations signed and stamped by the head of the agency or organization proving the grant, use of housing, transfer of housing, having a house built on land allocated by an agency or organization for housing (for housing, land under the management authority of an agency or organization).
