Vietnam: Order and procedures for dispatching officials according to Decree No. 138/2020/NĐ-CP

According to Article 26 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, mobilization of officials shall be carried out in the following cases:

- According to specific task requirements;

- According to master plans and plans on employment of officials within agencies and organizations and between agencies and organizations under decisions of competent agencies;

- Change the working position according to the Party's regulations and the law.

Heads of agencies or organizations assigned or decentralized to manage officials shall decide on the mobilization of officials under their management or submit them to competent authorities for decision in accordance with law. The order and procedures for dispatching officials are as follows:

- Based on the planning, work needs and capacity and forte of civil servants, heads of agencies and organizations assigned or decentralized to manage civil servants shall develop plans and measures to mobilize civil servants within their respective jurisdictions. vi for management, report to competent authorities for consideration and decision on implementation;

- Make a list of officials to be dispatched;

- Specific implementation measures for each case;

- For officials holding leadership and management positions, the order and procedures for mobilization shall be carried out as in the case of appointment of leading and managerial officials from other human resources as prescribed in Clause 3 Article 46 of this Decree.

Note: Before deciding to mobilize officials, the head of the agency assigned or decentralized to manage officials should meet with the official to clarify the purpose and necessity of seconding to listen to officials' proposals before making decisions according to their competence or report them to competent authorities for consideration and decision.
