Vietnam: Options for disposition of property

The Government of Vietnam issued Decree No. 167/2017/NĐ-CP on disposition of public property.

According to Decree No. 167/2017/NĐ-CP of Vietnam’s Government, options for disposition of property include:

- Retention of property for continued use.

- Forfeiture.

- Transfer.

- Sale of property on land, assignment of land use right.

- Change in purpose of land use.

- Transfer to local governments for management.

- Temporary retention for continued use.

- Using property as payment to investor when executing investment project in the form of a build-transfer contract.

The use of property as payment to investor when executing investment project in the form of a build-transfer contract shall be done in accordance with regulations of the Government on use of public property as payment to investors when executing investment projects in the form of build-transfer contracts.

In addition to the above-mentioned options, disposition of public property shall also be conducted under other forms.
