Vietnam: Operation methods and revenues sources from national railway infrastructure

According to Decree No. 46/2018/NĐ-CP of Vietnam’s Government:

Operation methods of national railway infrastructure:

- The managing agencies shall operate the national railway infrastructure directly.

- National railway infrastructure lease.

- National railway infrastructure concession within a specific term.

The national railway infrastructure lease and concession within a specific term shall ensure uniformity in operation and ensure that the management of the regulatory agency is related to the national railway operation.

The revenue sources from the national railway infrastructure include:

- Fees and charges in compliance with the law on fees and charges and other relevant laws.

-  Revenues earned from prices for using and providing services as prescribed by laws.

- Revenues earned from national railway infrastructure lease or concession within a specific term as prescribed in this Decree.

As for the national railway infrastructure serving public interests but not applying the operation methods specified above, the managing agencies shall manage and use this infrastructure as prescribed; it is not required to prepare and submit an operation scheme to the competent authorities for approval as prescribed in this Section. The Minister of Transport shall make a list of national railway infrastructure under his management to serve the public interests but not apply any of the methods specified above in consideration of the managing agency’s request.
