On November 27, 2020, the Government of Vietnam issued the Decree No. 138/2020/NĐ-CP on recruitment, use and management of officials.
According to Article 55 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, objects of rotation of officials include:
- Leading and managing officials in the planning of agencies and organizations;
- Leading and managing officials holding head-level positions which, according to regulations, cannot hold more than two consecutive terms in a locality or agency;
- Leading and managing officials, according to regulations, are not allowed to arrange local people.
Based on the requirements of tasks, master plans and plans to employ officials, leading and managing officials rotated in the system of agencies of the Communist Party of Vietnam, the State, and socio-political organizations. Positions are arranged and rotated according to the guidelines of the Party and the competent authorities.
Besides, according to Article 56 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, specific standards and conditions for circulation are as follows:
1. Having a firm stance, political ideology, and good moral character.
2. In the planning, with capabilities and prospects; always complete the assigned task well.
3. Basically meet the specific criteria and conditions of the transfer office.
4. Age conditions:
- Still working for at least two terms (10 years) from the time of rotation;
- Particularly, leading and managing officials rotation according to provision that they can not be assigned due to being local people and can not hold more than two consecutive terms in a locality, agency, organization or unit, must have enough working time for at least one term.
5. Having enough health to work.
