Recently, the Government of Vietnam has issued the Decree No. 138/2020/NĐ-CP of the Government of Vietnam on recruitment, employment and management of officials.
According to Article 23 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, at the end of the probationary period, the probationer must report the probation results in writing according to the contents specified in Clause 3 Article 20 of this Decree; the probationary instructor must comment and evaluate the probation results for the apprentice in writing. These documents shall be sent to the head of the agency employing officials. Within 05 working days from the date of receipt of the probationer's report and the comments and assessments of the probationary instructor, the head of the agency employing officials shall evaluate the political, ethical and work results of the apprentice. In case the probationer meets the requirements, the head of the agency employing officials shall send a written request to the head of the agency managing officials to decide on the appointment of ranks and salary arrangement for the recruited official.
In particular, the recruitment decision is annulled in case the apprentice fails to meet the requirements after the probationary period or commits violations to the extent that disciplinary action must be considered in accordance with the law on officials. The head of the agency employing officials shall request the agency competent to recruit officials to issue a written decision to cancel the recruitment decision in these cases. Apprentices whose recruitment decisions have been canceled, shall be subsidized by the agency employing officials with 01 month's salary, current allowance and transportation fee to the place of residence.
