Vietnam: Notes when establishing the list of dredging inland water areas

According to Article 18 of Circular No. 33/2019/TT-BGTVT of the Ministry of Transport of Vietnam, the list of dredging areas shall be established as follows:

- The inland waterway management authority shall establish a new list of dredging areas or update the list and submit such list to the Ministry of Transport or the provincial People’s Committee before June 30 every year.

- The list of dredging areas must contain the main contents prescribed in clause 3 Article 26 of Decree No. 159/2018/ND-CP of Vietnam’s Government.

- The Ministry of Transport shall consult provincial People’s Committees before announcing the list of dredging areas.

Conditions prescribed in the project contract shall be in line with regulations of law on contract and regulations prescribed in the following documents:

- Decision on announcing the list of tasks in the dredging project of the competent authority;

- Decision on approving the feasibility study reports of the dredging project of the competent authority;

- The result of contractor selection;

- The report on the evaluation of environmental impacts or plan for environmental protection is approved or certified in accordance with regulations;

- Decision or documents of approving the registration of collected products of the competent authority;

- Assurance of project contract performance.

Relevant provisions can be found in Circular No. 33/2019/TT-BGTVT of the Ministry of Transport of Vietnam, which takes effect from November 01, 2019.
