Vietnam: New regulations on comparing and selecting areas that can sink dredged material

On December 31, 2019, the Ministry of Natural Resources and Environment of Vietnam issued Circular 28/2019/TT-BTNMT stipulating technical regulations for the assessment of dredged material and the determination of areas for the disposal of dredged material in Vietnamese marine areas.

Based on the results of the evaluation of the impact of dredged material dumping activities on resources, the environment, marine ecosystems, and socio-economic, defense, and security activities in the proposed dumping areas and adjacent regions, a comparison is made to select the areas suitable for dumping dredged materials according to the requirements listed in Article 22 of Circular 28/2019/TT-BTNMT of the Ministry of Natural Resources and Environment of Vietnam, specifically as follows:

a) The degree of variation in physical, chemical, and biological characteristics caused by the dumping of dredged material on the water mass, seabed, and ecosystem at the proposed dumping area and adjacent regions;

b) The impact level of the dredged material dumping activity on resources, the environment, and marine ecosystems at the proposed dumping area and adjacent regions;

c) The impact level of the dredged material dumping activity on socio-economic, defense, and security activities at the proposed dumping area and adjacent regions;

d) The suitability of the proposed dredged material dumping area with infrastructure and the technical equipment serving the dumping activity;

đ) The ability to meet future dumping requirements.

The comparison is to select areas suitable for dumping dredged materials to compile results, specifically determining the coordinates, boundaries, and area of the marine regions used for dumping dredged materials, and including this in the Dumping Project content.

Other provisions can be found in Circular 28/2019/TT-BTNMT of the Ministry of Natural Resources and Environment of Vietnam, effective from February 18, 2020.
