Vietnam: New point regarding penalties for administrative violations in inland waterway traffic

On April 11, 2018, the Ministry of Transport of Vietnam issued Circular No. 18/2018/TT-BGTVT on amendments to a number of articles of Circular No. 12/2016/TT-BGTVT providing instructions on a number of articles of Decree No. 132/2015/ND-CP of Vietnam’s Government stipulating penalties for administrative violations in inland waterway traffic.

Circular No. 18/2018/TT-BGTVT of the Ministry of Transport of Vietnam amends and supplements principles of imposing penalties for administrative violations in inland waterway traffic. Specifically, new principles are as follows:

- Principles of imposing penalties for administrative violations against regulations on inland waterway traffic shall be in compliance with Article 3 of the Law on handling of administrative violations of Vietnam.

- Organizations and/or individuals that commit violations, competent persons, and relevant organizations and/or individuals must comply with regulations of the Law on handling of administrative violations, Decree No. 81/2013/ND-CP, Decree No. 97/2017/ND-CP, Decree No. 132/2015/ND-CP of Vietnam’s Government and Circular No. 18/2018/TT-BGTVT.

Relevant provisions can be found in Circular No. 18/2018/TT-BGTVT of the Ministry of Transport of Vietnam, which takes effect from June 01, 2018.
