Vietnam: Mobile telecommunications service provider shall be fined up to VND 20 million if the mobile subscriber's photo is not clear

This is one of the fines for mobile telecommunications enterprises in Vietnam specified in Decree No. 49/2017/ND-CP.

According to new regulations of Decree No. 49/2017/NĐ-CP of Vietnam’s Government, a fine ranging from VND 10,000,000 to VND 20,000,000 per POS shall be imposed on the mobile telecommunications service provider if the POS commits one of the following violations:

- Using subscriber information for improper purposes;

- Failing to get signature of the subscriber owner or of the legal representative of the organization, or of the authorized person on paper-based or digitized or electronic certificate of subscriber information;

- Concluding Contracts outside the POS;

- Failing to hang a signboard or hanging a signboard containing insufficient information as prescribed by law;

- Failing to post or insufficiently posting types of documents as prescribed by law;

- Failing to have equipment/facilities as prescribed by law;

- Digital representations or photos are not clear and sharp, or photos do not contain date and time of taking photo.

Note: The total fine shall not exceed VND 200,000,000 for each violation.

Decree No. 49/2017/NĐ-CP of Vietnam’s Government takes effect from April 24, 2017.
