Vietnam: Military Hospital 175 shall introduce occupational accident and occupational disease assessment for servicemen of the rank of colonel

Recently, the Ministry of National Defense of Vietnam has issued the Circular No. 136/2020/TT-BQP providing guidance on dossiers, processes and responsibilities for handling social insurance benefits within the Ministry of National Defense.

According to Article 18 of the Circular No. 136/2020/TT-BQP of the Ministry of National Defense of Vietnam, process and responsibilities for introducing occupational accident and occupational disease assessment to servicemen; persons who do cipher work receiving salary as servicemen; national defense officials, workers and national defense employees; workers under contracts in agencies, units and enterprises attached to the Ministry of National Defense are specified as follows:

- For employees: Submit the assessment dossier as guided in Clause 1 and Point a Clause 4 (except for Clause 3 Article 13), or Point b Clause 4 (except for Clause 5 Article 14), or Point c, d, dd Clause 4 Article 12 of this Circular to the personnel agency of the regiment level and the equivalent.

- Personnel agency of the regiment level and the equivalent: Receive, examine, appraise and complete medical assessment dossiers according to regulations and transfer the dossiers to the superior personnel agency to the personnel agency of the unit under the Ministry.

- Ministerial-attached personnel agency: Receive dossiers from lower-level personnel agencies, appraise and recommend workers for assessment according to their competence, or transfer dossiers to the Social Security of the Ministry of National Defense for appraisal and introduction, then receive dossiers back from the Social Security of the Ministry of Defense to transfer to the Medical Assessment Council according to the recommendation letter of the Social Security of the Ministry of National Defense.

- Authority to introduce expertise:

+ The personnel agency appraising dossiers shall report to the head of the unit competent to recommend to the Medical Assessment Council of the competent level in the Ministry of National Defense (except for the Medical Assessment Council of the Ministry of National Defense, the Medical Assessment Council for occupational disease of the Ministry of National Defense, the Medical Assessment Council of the Military Hospital 175) for the employee with the rank of Captain or employee receiving the salary equivalent to the rank of Captain or below when suffering the first occupational accident;

+ The Social Security Agency of the Ministry of Defense appraises the application and introduces it to the Medical Assessment Council of the Ministry of National Defense, the Medical Assessment Council for occupational disease of the Ministry of National Defense, the Medical Assessment Council of the Military Hospital 175 for employees suffering first occupational accident with the rank of Major or receiving or the salary equivalent to the rank of Major or higher (calculated at the time of assessment introduction); introduces assessment for employees suffering from occupational diseases and cases of occupational accidents and diseases for re-examination, assessment of injuries and recurrent diseases, and general assessment.
