Vietnam: Methods of market surveillance by State Securities Commission

On October 25, 2017, the Ministry of Finance of Vietnam issued Circular No. 115/2017/TT-BTC on guidelines for securities market surveillance. According to this Circular, methods of market surveillance by State Securities Commission (SSC) include:

First, according to trading data provided by the Stock Exchange (SE), SSC will analyze, evaluate, and take actions as prescribed in regulations on securities transactions showing irregular signs.

Second, market surveillance shall be carried out according to information from the sources below:

- Surveillance reports of SE, Vietnam Securities Depository (VSD), and exchange members;

- Reports of listed companies;

- Reports of entities engaging in transactions on securities market;

- Sources on means of mass media, rumors;

- Other sources.

Third, carry out irregular inspection of supervisees by discovering indicative of irregular trading according to reports of SE, VSD, exchange members and entities participating in trading and providing trading-related services on the securities market.

More guidelines can be found in Circular No. 115/2017/TT-BTC of the Ministry of Finance of Vietnam, which takes effect from December 08, 2017.
