Vietnam: Methods of disposal of state property within the Ministry of National Defense removed from the property distribution

This is the important content stipulated in Circular 126/2020/TT-BQP on the on removal from the property distribution and disposal of state property within the Ministry of National Defense of Vietnam, dated October 19, 2020.

According to Circular 126/2020/TT-BQP, the methods of disposal of state property within the Ministry of National Defense removed from the property distribution Vietnam are as follows:

1. Guns and artillery: Commanders of military zones direct affiliated units to organize the collection to military zone warehouses and workshops; other agencies and units report to the Chief of General Staff to decide to collect them to the Ministry of National Defense warehouses:

- Organize assembly, repair and restoration; dismantle and utilize auxiliary materials, parts, and components for repair;

- Utilize as training models; serve training, museum display, and other military defense duties;

- For infantry guns that are no longer intact and parts that can no longer be used for dismantling, assembly, repair, and restoration, units shall report to the Minister of National Defense of Vietnam for consideration and decision on removal from the property distribution and disposal;

- Other types shall be securely stored and managed by the assigned unit until the decision from the Minister of National Defense of Vietnam is issued.

2. Ammunition and hazardous chemicals: dispose of (destroy, dismantle) according to methods complying with the industry's regulations and approved processing technology procedures, ensuring absolute safety.

3. Items recovered after disposal of ammunition:

- Usable items are collected and stored centrally at the Ministry of National Defense warehouses or depots for repair or production as required for tasks;

- Artillery shell casings and copper materials that are recovered after disposal of ammunition and cannot be repaired or restored shall only be processed after a written opinion from the Minister of National Defense of Vietnam;

- Items, materials, and scrap that are recovered from disposal and cannot be utilized for ammunition repair or production, used as training models, or have been completely deformed and rendered non-explosive and incapable of being restored to their original state for recycling in production, shall be auctioned publicly to military factories with the technology to melt and cast material billets for national defense missions;

- Explosives obtained from dismantling and draining ammunition shall only be publicly auctioned to military units and factories qualified to recycle and produce industrial explosives;

- Recovered items and scrap from ammunition processing shall not be sold outside the military.

4. Property including technical equipment, materials, and goods:

- Destroy absolutely safely information-storing devices and toxic chemicals;

- Dismantle usable parts and components (over 50% quality of new parts and components) for technical assurance tasks;

- Utilize as training models to serve training, display, and other military defense duties;

- The remaining items, after deactivating their military capabilities, shall be publicly auctioned to legally qualified units both within and outside the military.

5. Materials and items recovered during the demolition and destruction of combat works, defense works, houses, and properties attached to the land shall be publicly auctioned according to current legal regulations.

6. For specially controlled drugs in the military, dispose of them according to pharmaceutical laws and military medical sector guidelines.

7. Cases not falling under clauses 1, 2, 3, 4, 5, and 6 of Article 13 shall be decided by the Minister of National Defense of Vietnam.
