On July 03, 2017, the Government of Vietnam issued the Decree No. 77/2017/NĐ-CP on management and protection of security at port checkpoints. Measures to carry out border guard inspection and supervision are stipulated as follows:
1. Check and compare information about the electronic or physical declaration submitted by the applicant to documents presented by him/her.
2. Check and compare the documents to the appearance of the holder of such documents.
3. Check and compare information of the documents to the activities of people and operation of vehicles to which such documents are granted to.
4. Carry out on-board inspection and supervision if:
- The vessel carries foreign tourists;
- The vessel or people thereon commit violations against regulations of law on immigration and security;
- If the vessel or people thereon commit violations against regulations of law on customs, maritime and epidemic prevention and control, the port border guard shall conduct on-board inspection and supervision at the request of state authorities responsible for port management;
- There is a stowaway;
- There is proof of wrong declaration on the vessel, seamen or passengers;
- The inspection and supervision of the vessel need to be carried out upon the request of the shipowner or the shipmaster;
- Leader of the port border guard station and head of port border guard shall make a decision on carrying out on-board inspection and supervision and take responsibility for their decision.
5. Supervise areas of wharves and waters at the port.
6. Supervise directly at the port gate and control station.
7. Supervise by using technical equipment.
8. Carry out foot patrol and control.
9. Take professional actions according to regulations of law.
