Vietnam: Matters to be checked for the proposal for conclusion and accession to international treaties within the People's Public Security Force

On October 29, 2012, the Ministry of Public Security issued Circular 63/2012/TT-BCA stipulating the proposal to sign, accede to, and implement international treaties; proposals for signing and implementing international agreements within the People's Public Security Forces.

Under Article 16 of Circular 63/2012/TT-BCA, matters to be checked for the proposal for conclusion and accession to international treaties within the People's Public Security Force in Vietnam include:

- Checking and comparing with the requirements for international legal cooperation in the protection of national security, maintenance of order, and social safety within the functions of the Ministry of Public Security;

- Checking documents and materials required in the proposal for conclusion and accession to international treaties;

- Comparing the Vietnamese translation with the official or third language of the international treaty.

Additionally, Circular 63/2012/TT-BCA also stipulates the matters to be appraised and checked for the proposal for the conclusion of international agreements within the People's Public Security Force in Vietnam as follows:

- Matters to be appraised for the proposal for the conclusion of international agreements include:

+ The necessity of the conclusion of the international agreement;

+ Legal basis and foundation;

+ Constitutionality, legality, and conformity of the draft international agreement with relevant international treaties to which Vietnam is a member and with the functions, tasks, and powers of the Ministry of Public Security;

+ Compliance with the conclusion procedures and sequence;

+ The feasibility of the international agreement;

+ Assessment of the political, economic, social, and other impacts.

- Matters to be checked for the draft international agreement:

+ Comparison with the international cooperation requirements of the Ministry of Public Security;

+ Checking of the Vietnamese version with the language of the country of the international agreement partner with the Ministry of Public Security.
