Vietnam: Maritime occupational accident dossier

Circular No. 13/2017/TT-BLĐTBXH of the Ministry of Labour, War Invalids and Social Affairs of Vietnam on providing for statement, statistical investigation and reporting on occupational accidents in maritime sector was issued on May 15, 2017. One of the notable contents of this Circular is the regulation on maritime occupational accident dossier. To be specific:

1. The maritime occupational accident dossier includes:

- The scene examination record (if any);

- The scene diagram;

- The scene’s pictures, the victim’s pictures;

- The copy of the post-mortem examination or injury examination record, excluding accidents in which victims are missing as declared by the competent Court;

- The copy of the technical, forensic examination record or the conclusion of judicial expertise (if any);

- The testimony record of the victim, the persons that know the incident or the persons related to the accident;

- The maritime occupational accident investigation record;

- The minute of the meeting about the disclosure of the maritime occupational accident investigation record;

- The injury confirmation from the hospital where the victim is treated (if any);

- The discharge note from the hospital where the victim is treated (if any);

- The certified copies of the documents mentioned in Point a, Point b, Point d, Point dd, Point e Clause 1 Article 10 of Circular No. 13/2017/TT-BLĐTBXH if the maritime occupational accident occurs outside the territory of Vietnam (if any).

2. In case of missing, the dossier includes:

- The testimony record of the persons that know the incident or the persons related to the accident;

- The Court’s decision to declare a person missing;

- The maritime occupational accident investigation record;

- The minute of the meeting about the disclosure of the maritime occupational accident investigation record.

3. In case there are many victims in the same maritime occupational accident, each victim must have a separate dossier.
