“How long is the probationary period of persons recruited to be officials?” This is the question that recently LawNet has received a lot from Customers and Members, LawNet would like to answer as follows:
According to Article 20 of Decree No. 24/2010/NĐ-CP of Vietnam’s Government, persons recruited to be officials shall implement the probation regime to acquaint themselves with the working environment and practice jobs of the working positions to which they have been recruited.
According to Article 10 of Decree No. 140/2017/NĐ-CP, Clause 12 Article 1 of Decree No. 161/2018/NĐ-CP of Vietnam’s Government amending Clause 2 Article 20 of Decree No. 24/2010/NĐ-CP, probationary period of persons recruited to be officials is specified as follows:
- 12 months for type-C officials;
- 06 months for type-D officials;
- 03 - 12 months for excellent graduates, young scientists recruited as officials, except for cases where they have worked professionally and professionally for 12 months or more.
Maternity leave under the social insurance regime, sick leave of 14 days or more, leave without pay, and the period during which the public employee is held in custody or temporary detention, or suspended from work in accordance with law must not be counted into the probation period.
Note: An official shall be exempted from probation if he/she is appointed to working position related to his/her training discipline or previous working position and his/her working period with compulsory social insurance contributions made (working periods for which the payment of compulsory social insurance contributions is interrupted shall be also accumulated) is equal or longer than the probation period prescribed above.
