On November 16, 2020, the State Bank of Vietnam issued the Circular No. 14/2020/TT-NHNN on judicial survey in respect of currency and banking sector.
According to Article 18 of the Circular No. 14/2020/TT-NHNN of the State Bank of Vietnam, the person solicited shall prepare the expertise according to the provisions of Clauses 2 and 3, Article 17 of this Circular. For the State Bank's decision to directly solicit judicial expertise or ad hoc judicial expertise to join the Judicial Expertise Team established by the expert solicitor, the solicited persons shall prepare according to the assignment of the expertise solicitors and the judicial expertise teams.
Besides, according to Article 19 of the Circular No. 14/2020/TT-NHNN, judicial assessors and case-based judicial experts shall:
- Rent machinery, means, equipment and services related to the assessment contents and requirements, which have been formulated in the assessment outline (if any) and have been notified to the person requesting the assessment.
- When new contents or other problems arise during the assessment, a written notice shall be immediately sent to the person soliciting the expertise to agree on a settlement plan.
- Based on each content of expertise request of the expert solicitor, judicial expert or case-based judicial expert shall examine and compare the contents of the dossier, the object of expertise, information, documents, objects and samples have been provided with professional standards to make comments and evaluate each content requiring specific assessment.
- Make a timely, complete and truthful record of the entire process and results of the assessment according to Appendix 04 issued with this Circular.
