On October 16, 2023, the Ministry of Natural Resources and Environment of Vietnam issued Circular 14/2023/TT-BTNMT on amendments to some Articles of Circulars on submission and presentation of household registration books and documents related to residence upon carrying out administrative procedures or providing public services in the field of land.
Clause 1, Article 1 of Circular 14/2023/TT-BTNMT amends and supplements point a, clause 1, Article 5 of Circular 23/2014/TT-BTNMT (as amended and supplemented by clause 4, Article 6 of Circular 33/2017/TT-BTNMT), specifying information about land users, and owners of properties on land issued with certificates as follows:
- For domestic individuals, the information recorded shall include "Mr." (or "Ms."), followed by their full name, year of birth, type and number of identity documents (if any), and permanent address.
If the identity document is a People's Identity Card, it is recorded as “ID No.:…”;
If it is a Military Identity Card, it is recorded as “MID No.:…”;
If it is a Citizen Identity Card, it is recorded as “CIC No.:…”;
If there is no People's Identity Card or Citizen Identity Card, it is recorded as “Birth Certificate No.” or “Personal Identification Number:…;”
Thus, under the new regulations, domestic individuals are allowed to use personal identification numbers instead of other personal documents to record information on the land use rights certificate.
According to point g, clause 1, Article 17 of Circular 23/2014/TT-BTNMT as amended and supplemented by clause 14, Article 6 of Circular 33/2017/TT-BTNMT on the certificate of land use rights, ownership of houses, and other properties on land:
Land users and owners of properties on land are allowed to:
+ Change their names;
+ Confirm changes related to the entity, identity document number, CIC number, and address on the issued certificate at the request of the land user or property owner attached to the land;
+ Confirm changes related to the entity, identity document number, CIC number, and address on the issued certificate simultaneously with the procedure for registering changes in land or properties on land.
According to clause 7, Article 18 of Circular 23/2014/TT-BTNMT as amended and supplemented by clause 18, Article 6 of Circular 33/2017/TT-BTNMT, the confirmation of the changes to the personal information specified in the issued land use rights certificate as follows:
- In case the land user or owner of property on land changes the ownership and information about proof of legal status, identity documents or address, specify “The land user (or owner of property on land)… (specify the changes: name, ID Card, investment certificate, address, etc.) từ… thành… (is changed from… to…(specify the information before and after change) theo hồ sơ số… (according to the application No… (specify the number of the registration application)”.
- The changes that are not subject to transfer of land use rights, ownership of property on land such as the households’ or individuals’ moving of land use rights into a company; conversion of a company; full division, partial division, merger or consolidation of a company without subdivision of land parcel and confirmation of changes in the certificate, specify “The land user (or the owner of property on land) đổi tên từ … thành… (is renamed from ... to….) (specify the name and proof of legal status before and after change) do… (due to ...) (specify the form of establishment or company conversion or …) theo hồ sơ số… (according to the application No...) (specify the number of registration application).
