On August 26, 2020, the Government of Vietnam issued the Decree No. 97/2020/NĐ-CP on increased limits of air carrier liability in carriage by air.
The Decree No. 97/2020/NĐ-CP of Vietnam’s Government has specified increased limits of air carrier liability in carriage by air as prescribed in Clause 1 Article 166 of the Law on Vietnam Civil Aviation 2006, specifically as follows:
1. As for carriage of passengers, the limit of liability for death or injury of passengers shall increase from one hundred and thousand (100,000) units to one hundred twenty eight thousand eight hundred two fifty one (128,821) units per passenger.
2. As for carriage of passengers, the limit of liability for damage caused by delay shall increase from four thousand one hundred and fifty (4,150) units to five thousand three hundred forty six (5,346) units per passenger.
3. As for carriage of baggage, including both checked and hand baggage, the limit of liability for the loss or lack of, or damage to, baggage or delay shall increase from one thousand (1,000) units to one thousand two hundred and eighty-eight (1,288) units per passenger.
4. As for carriage of cargo, the limit of liability for the loss, lack, damage or delay shall increase from seventeen (17) units to twenty two (22) units per kilogram of cargo.
